Privacy and Safety Notice

This Privacy and Safety Notice explains how [FULL LEGAL NAME], doing business as AskToHeal.com, collects, uses, retains, and discloses information in connection with the Digital Biblical Counselor.

This Notice applies to the Counselor interface and related support communications. A separate general website privacy policy should address other AskToHeal features such as the forum, library, email list, donations, analytics, and embedded media. If the policies conflict regarding Counselor conversations, this more specific Notice controls.

2. Important HIPAA Statement

AskToHeal is not a health plan, health care clearinghouse, covered health care provider, or business associate under the Health Insurance Portability and Accountability Act, commonly called HIPAA. The Digital Biblical Counselor is not a HIPAA covered service, and information submitted to it should not be assumed to be protected health information under HIPAA.

This document is a Privacy and Safety Notice, not a HIPAA Notice of Privacy Practices. If AskToHeal later provides services for a HIPAA covered entity or becomes a covered entity or business associate, this Notice must be replaced or supplemented with legally compliant HIPAA documentation and operational safeguards.

3. Information We Collect

Depending on how you use the Service and how it is configured, we may collect:

Conversation content: Questions, descriptions, feedback, and other text you choose to enter, along with responses generated by the Service.
Sensitive information you voluntarily reveal: Religious beliefs, family circumstances, relationship history, mental or physical health concerns, sex life or sexual orientation, allegations of abuse, legal disputes, or similar sensitive matters. We ask you to avoid identifying details and provide only what is necessary.

Support communications: Information you provide when contacting us about privacy, technical support, safety, or other concerns.
Donation information: If you donate, a payment processor may collect payment and billing information under its own privacy terms. AskToHeal should not store complete payment card numbers. Donation data is not part of a Counselor conversation unless you place it there, which you must not do.

4. Information You Should Not Provide

Do not enter:

Full names or identifying details about yourself or another person.
Home or work addresses, phone numbers, personal email addresses, precise locations, or account passwords.
Social Security numbers, government identification numbers, financial account information, or payment card information.
Medical records, psychotherapy notes, genetic data, photographs, biometric identifiers, or insurance information.
Court records, sealed documents, discovery material, privileged communications, or information restricted by a court order.
Private information about a child or any content submitted by a person under 18.
Anything you do not have the legal right to provide.

Use initials, approximate ages, and generalized descriptions instead.

5. How We Use Information

We may use information to:

Receive a question and generate a response.
Operate, maintain, troubleshoot, secure, and improve the Service.
Detect fraud, abuse, prohibited conduct, malicious activity, or technical failures.
Respond to privacy, support, and legal requests.
Enforce our Terms and protect users, other people, AskToHeal, and our providers.
Comply with applicable law and valid legal process.
Create aggregate or deidentified statistics that cannot reasonably be linked to a person.

We will not use sensitive Counselor content for targeted advertising. We do not sell Counselor content or other personal data.

6. Artificial Intelligence and Technology Providers

To generate responses, Counselor content is transmitted to [NAME EACH AI MODEL OR API PROVIDER]. Hosting, database, security, analytics, email, and support providers may also process limited information on our behalf.

Our contracts and settings should require providers to use Counselor content only to provide, secure, and maintain contracted services, not for their own targeted advertising or training of publicly available or general purpose AI models.

Authorized AskToHeal personnel or contractors may review limited conversations when reasonably necessary to investigate abuse, address a support request, correct a technical problem, evaluate safety, or comply with law.

7. When We Disclose Information

We may disclose information:

To contracted providers that host, process, secure, maintain, analyze, or support the Service, subject to appropriate restrictions.
When reasonably necessary to comply with applicable law, a valid court order, subpoena, warrant, or other lawful process.
When we reasonably believe disclosure is necessary to protect the rights, property, or safety of AskToHeal, a user, another person, or the public, including situations involving a serious and imminent threat, to the extent permitted by law.
To investigate and prevent fraud, abuse, security incidents, prohibited conduct, or violations of the Terms.
As part of a merger, financing, reorganization, sale of assets, or transfer of the Service, subject to applicable law and appropriate notice.
With your direction or specific consent.

We do not promise that we can identify emergencies or harmful content, and we do not continuously monitor conversations.

8. Sensitive Information Consent

The Counselor cannot respond to a question without processing the text you submit. Because that text may reveal religious beliefs, mental or physical health concerns, family conflict, sex life or sexual orientation, or other sensitive information, we request separate affirmative consent before you enter the Counselor.

You may withhold consent by not using the Counselor. You may withdraw consent for future processing by ending use and contacting [PRIVACY EMAIL]. Withdrawal does not affect processing that lawfully occurred before withdrawal and may not require deletion when retention is legally required or reasonably necessary for security, fraud prevention, dispute resolution, or enforcement.

9. Cookies, Analytics, and Advertising Technologies

The Counselor page uses only technologies reasonably necessary to operate the session, record consent, prevent abuse, and maintain security. It does not use Counselor content for targeted advertising. Advertising pixels, social media pixels, session replay tools, and behavioral advertising technologies are not placed on the Counselor page. Conversation text is not sent to analytics or advertising platforms.

10. Retention and Deletion

Counselor conversations are retained for [EXACT PERIOD] and then deleted or deidentified, unless a longer period is reasonably necessary for security, legal compliance, dispute resolution, or enforcement. Consent records are retained for [EXACT PERIOD] to document the agreement. Server and security logs are retained for [EXACT PERIOD]. Backups may retain deleted data for up to [EXACT PERIOD] before automatic expiration.

Deidentified information may be retained longer only if we take reasonable measures to prevent reidentification and do not attempt to reidentify it.

11. Security

We use reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information we process. These include encryption in transit, encryption at rest, access controls, and logging. [LIST VERIFIED MEASURES AS CONFIRMED.]

No online system is completely secure. We cannot guarantee that unauthorized access, loss, misuse, or disclosure will never occur. You reduce risk by withholding identifying information and using general descriptions.

12. Data Breach Notice

If a security incident involving personal information occurs, we will investigate and provide notices to affected individuals, regulators, or others when and as required by applicable law. Depending on how the Service is configured and what information it maintains, federal or state health data breach laws may also apply.

13. Your Privacy Choices and Rights

Depending on where you live and subject to legal exceptions, you may have rights to request access to, correction of, deletion of, or a copy of personal data we maintain about you. You may also have rights to withdraw consent, opt out of certain processing, or appeal a denied request.

Because anonymous or pseudonymous conversations may not be reasonably linkable to a requester, we may be unable to identify or retrieve a particular conversation without a valid session or account identifier.

We will not unlawfully discriminate or retaliate against you for exercising a privacy right.

14. Adults Only and Children's Privacy

The Counselor is not directed to people under 18, and we do not knowingly permit them to use it. Do not submit personal information about a child. If you believe a person under 18 has used the Counselor or that personal information about a child has been submitted, contact [PRIVACY EMAIL] so we can investigate and take appropriate action.

15. United States Service

The Counselor is intended for users located in the United States. Information may be processed and stored in the United States and in other countries where our contracted providers operate. Those countries may have different privacy laws.

If the Service is offered to people outside the United States, obtain legal review for the laws of those jurisdictions before launch.

16. Changes to This Notice

We may revise this Notice as the Service, technology, or law changes. We will post the revised Notice with a new effective date. If a change materially affects how Counselor content or sensitive information is collected, used, or disclosed, we will provide prominent notice and request renewed consent before the next counseling session when required.
